Terms & Conditions

1. General Terms

These Terms & Conditions apply to all real estate transactions facilitated by our company in the United States. By using our services, clients agree to comply with the terms and conditions outlined herein, as well as all applicable federal, state, and local laws governing real estate transactions.

2. Property Listings & Availability

  • All property listings are subject to availability and may be withdrawn or altered at any time without prior notice.
  • Prices, promotions, and offers are subject to change at the discretion of the seller or developer.
  • Our company ensures that all properties listed for sale comply with relevant real estate laws and are legally approved for transaction.

3. Eligibility & Buyer Qualifications

  • Buyers must meet the legal requirements set forth by the applicable state, including but not limited to credit checks, proof of funds, and eligibility to purchase real estate in the U.S.
  • Non-U.S. citizens or foreign nationals may be required to provide additional documentation and meet specific legal conditions to purchase property in the United States.

4. Reservation & Payment Terms

  • A deposit is required to reserve a property, and the amount of the deposit will be specified in the sales agreement. The deposit is generally non-refundable, except in cases where the seller fails to meet contractual obligations.
  • Buyers must adhere to the payment schedule outlined in the sales contract, including down payments and any other agreed-upon payment plans.
  • Payments should be made through wire transfers, certified checks, or other mutually agreed-upon methods. Late payments may result in penalties, and failure to make payment could result in the forfeiture of the deposit.

5. Closing Process & Title Transfer

  • The closing process is typically conducted through a licensed title company or escrow service, and the buyer and seller will sign all necessary documents to complete the transaction.
  • Both parties must provide all required documents to ensure the timely and successful transfer of title.
  • The buyer is responsible for the closing costs, which may include title insurance, inspection fees, appraisal fees, transfer taxes, and attorney fees, unless otherwise agreed upon in the contract.

6. Financing & Mortgages

  • Buyers must secure financing through an approved lender if financing is required for the purchase.
  • The buyer is responsible for all mortgage-related fees and costs, including but not limited to loan application fees, interest rates, and insurance premiums.
  • It is recommended that buyers pre-qualify for financing before making an offer on a property.

7. Property Inspections & Disclosures

  • Buyers are encouraged to conduct a thorough inspection of the property to assess its condition before finalizing the purchase.
  • Sellers are required by law to provide disclosures regarding the condition of the property, including any known defects or hazards. Failure to provide full disclosure may result in legal consequences.
  • Any issues identified during the inspection may be negotiated or addressed through repairs or financial adjustments before the transaction is finalized.

8. Refund & Cancellation Policy

  • Once a purchase agreement has been signed, cancellations are subject to the terms of the agreement. In most cases, deposits are non-refundable unless the seller fails to fulfill the terms of the contract.
  • Buyers who wish to cancel the transaction must do so in writing, and cancellations may be subject to penalties as defined in the contract.

9. Liability & Disclaimer

  • Our company acts as an intermediary between buyers and sellers and does not assume liability for any disputes, defects, or issues arising after the property transaction has been completed.
  • We make every effort to ensure that the properties listed meet all relevant standards and regulations, but buyers are encouraged to perform their due diligence, including reviewing the title, zoning, and inspection reports before making a purchase.
  • Our company does not provide legal advice; we recommend that buyers consult an attorney or other professional advisors when necessary.

10. Governing Law & Dispute Resolution

  • These Terms & Conditions are governed by the laws of the state in which the property is located and the United States federal law.
  • Any disputes arising from a transaction shall be resolved through negotiation, mediation, or, if necessary, litigation in the appropriate state or federal court.

By proceeding with a transaction, buyers and sellers acknowledge and agree to the Terms & Conditions outlined above.
